What is a trademark?

A trademark is a type of intellectual property. It represents a recognisable sign, design or expression that distinguishes products and services from others.

How a trademark can protect your brand

Stop your brand from getting stolen
Without a trademark, competitors can use your brand for their own business. If they manage to register a trademark before you, you may be coerced to abandon your own brand and start afresh.
Prevent counterfeits
When you have a good brand, there will be others who will try to use your brand’s name or logo on their inferior goods. Having a registered trademark stops counterfeiters and punishes them for copying.
Safeguard your brand from future tussles
By registering for a trademark, you prevent others from registering identical trademarks. This will save you the trouble of having to deal with competitors trying to register your trademark in the future.
Adds value to your business
A registered trademark indicates you have full ownership of your brand. It shows potential investors that you are serious about your branding rights and have fully protected them.

How is the trademark registration procedure like

There are two kinds of trademarks, the local trademark and the overseas trademark. You can choose your preferred trademark depending on whether you would like to register on a local or a global scale.
Local Trademarks
For the local trademark, the procedure is as follows.
1. Provide us with these basic information:

- Type of trademark required (Word, phrase, logo, design)
- Industry relevant to the trademark
- Owner of trademark (Can be person or company)
2. We will conduct a complimentary search on the availability and feasibility of your trademark.
3. Once your trademark is confirmed to be available and feasible, we will confirm your trademark registration service and send you an invoice.
4. We submit your trademark application to the Intellectual Property Office of Singapore (IPOS) within 1 business day after payment is made. A trademark application acknowledgement letter will be emailed to you on the same day.
5. Trademark will be approved after 6 months should there be no objections. We will send you the trademark certificate by registered mail, and email you a copy of the certificate.
Overseas Trademarks
There are 2 different filing routes when applying for an overseas trademark. You can choose between the Madrid Protocol or the National Application filing route.

The Madrid Protocol is an international treaty that allows you to register for a trademark in any of the countries that have joined the Madrid Protocol.

You just have to fill up a single application. We have compiled
a list of countries in the
Madrid Protocol for you.

The National Application filing route covers overseas trademark filing in countries that did not join the Madrid Protocol.

Here’s a table illustrating the differences between the 2 filing routes.

If the application is rejected, the Registry will notify you about the corrections required. You will also be given a specific time period for appeal. We will work with you on the appeal and get your application approved.
6. The Head Office of the Trademark Registry will publish your application in the Trade Marks Journal. Anyone may oppose the registration of the trademark within a 2 month period after publication. We will work with you to resolve any objections.
